INTRODUCTION
These Terms and Conditions (the “Terms”) apply to the Valuing Homes in Black Communities Challenge (the “Challenge”) created by Ashoka (referred to as “Ashoka”).
DEFINITIONS
“Applicable Data Protection Law” means any applicable laws related to the protection and/or processing of personal data and privacy, anywhere in the world, including the General Data Protection Regulation (EU) 2016/679 (“GDPR”); each as applicable to Ashoka, and each as amended, repealed, consolidated, or replaced from time to time.
“Applicant” or “Participant” refers to any individual or organization that begins an application through the Service with the intention of participating in the Challenge. Within these Terms, the Applicant or Participant may also be referred to as “you” or “your”.
“Applicant Information” refers to Personal Data and Sensitive Personal Data contained in an Applicant’s Entry or in a prospective Applicant’s proposed entry through the Service.
“Awards Jury” or “Challenge Jury” refers to the individuals selected, in the sole discretion of Ashoka, to judge the Entries, which may include Ashoka employees or members of their larger networks or others who are not employed by or otherwise affiliated with the Ashoka.
“Confidential Information” refers to non-public Personal Data and Sensitive Personal Data.
“Entry” refers to any data the Applicant provides through the Service that contains relevant information, including Personal Data, for the purposes of participating in the Challenge. An “Eligible Entry” is an entry that meets the Challenge eligibility requirements.
“Personal Data” includes, but is not limited to, the following categories of information: any information that relates to an identified or identifiable natural person; name, address, email address, social media handle, photographs, and contact information; organization (including the organization’s name, website, phone number, and address), fields of work, languages, and location; username and password; the results of any questionnaires that you respond to; demographic information, such as age, racial or ethnic origin, and religion; and your personal interests.
“Sensitive Personal Data” includes data revealing racial or ethnic origin, political opinions, religious or philosophical beliefs, trade union membership, genetics, biometrics, health and disability information, immigration / refugee status and information regarding a person’s sex life or sexual orientation and how they gender identify.
“Service” refers to https://challenges.changemakers.com/challenge/valuing-homes-in-black-communities hosted by WeChangers, and affiliated websites or services that are used and operated for the purpose of executing or administering the Challenge.
CHILDREN AND YOUTH
The Challenge is not open to Applicants under the age of 18. Any Entry submitted by an Applicant under the age of 18 will be rejected and all submitted data will be deleted. By submitting an Entry, the Applicant affirmatively states that they are at least 18 years of age.
DATA PROTECTION AND CONFIDENTIALITY
The information you submit through the Service will be held, used, and disclosed to others. When you submit Applicant Information to the Service, you are directing and consenting to it being submitted to Ashoka (the administrator of the Challenge) and WeChangers (the host of the Service), for each of their use pursuant to their own privacy policy. Applicant Information will be accessible by Ashoka and the host of the Service (WeChangers).
Once an Applicant submits an Entry, Personal Data and Sensitive Personal Data can be visible on the Service platform.
Please take note that:
- (A) your username (which may be your full name if you elected to use your name to create your username), profile photo, city and state and the identity of other communities at changemakers.com that you are a member of may be visible to other Applicants at the Challenge Community space; and(B) your username, the cover image for your project, your profile photo, your project title, summary, sector, theme, focus, stage, URL, social media handles, location of impact and other information about your project that you add in your application’s “About Your Project” form will be visible by other Applicants, as well as by the general public.Exclusively in the review phase, in order to evaluate your Entry, the Awards Jury for all review phases and the peers joining community review activities will have access to the information described in (A) and (B) above, as well as to your pitch video, if you submit one on the Service.For some of the information described in (A) and (B) above, you can control whether that information is viewable by other Applicants and the general public in your account settings by logging in into the Challenge platform, accessing the community and going to “Settings” in your user menu. Your username, “About Your Project” narrative, and Cover Image will be viewable by other Applicants and the general public and you will not be able to modify the “Settings” on these items.For additional information about the collection, use and disclosure of Applicant Information, please see the policies, disclosures, and term of use of the parties who receive, use and share Applicant Information:

The collected data will be used by Ashoka and third parties involved in the Challenge for the purpose of allowing the management, monitoring, and evaluation of projects and support; it is based on Ashoka’s legitimate interest in the management, monitoring and evaluation of its supported initiatives and projects, as well as by the Applicants’ consent. By submitting an Entry, the Applicant agrees that Ashoka may process information included in the Entry for the purposes of administering the Challenge.
Ashoka reserves the right to share information from the Entry with third parties for the purpose of any activity directly related to the Challenge that is not prohibited under Applicable Data Protection Laws. Ashoka seeks to use reasonable measures to protect the Applicant Information within its own organization. Ashoka will implement appropriate measures to ensure the Applicant’s Confidential Information is not actively revealed to any third party that is not necessary to such related activities. Ashoka is not liable for unintentional disclosure of Confidential Information, including Personal Data, to any third party so long as such appropriate measures are in place to prevent disclosures. Ashoka is not responsible for the acts or omissions WeChangers or of any other third party.
To the extent permitted by applicable law and when explicitly authorized by the Applicant, Ashoka may use Applicant Information to inform Applicants of information related to the Challenge (including future year’s challenges or related alumni events), Ashoka initiatives similar to the Challenge, funding opportunities that come through partners and universities, and media opportunities with key thought leaders. Ashoka may disclose certain information about Winners (as defined below), such as their names, photos, and biographical and project information, to the public in recognizing these Winners and in connection with promoting the Challenge.
The data will be processed during the duration of the Challenge, and may be kept by Ashoka, for an indefinite period, in the context of its activity of management and conservation of the cultural, intellectual, and artistic collection.
Applicant Information will be held and processed by Ashoka during the duration of the Challenge and may be retained for as long as required or permitted under applicable laws, in the context of its activity of management and conservation of the cultural, intellectual, and artistic collection. Applicants can request access to, modification of, or deletion any of their Personal Data, as stipulated under Applicable Data Protection Laws, by contacting Ashoka via email at economicarchitecture@ashoka.org.
INTELLECTUAL PROPERTY
Applicants who start an Entry that contains the Applicant’s intellectual property retains their individual rights to their work and any derivative works.
By submitting an Entry, an Applicant certifies and warrants that their Entry is original and that they are the sole and exclusive owner and right holder of the submitted Entry and/or that they have the right to submit the Entry for the Challenge. Each Applicant agrees not to submit any Entry that (1) infringes any third party proprietary, intellectual property, industrial property, personal rights or other rights, including without limitation, copyright, trademark, patent, trade secret or confidentiality obligation; or (2) otherwise violates applicable law in any countries in the world.
By submitting copyrighted material you certify that you have obtained the necessary permissions from the copyright owner in writing. You assume responsibility for any associated penalties and costs incurred as a result of a copyright violation related to this material.
Nothing in these Terms shall be considered or is intended to confer or transfer to either Party any ownership right or interest in any intellectual property right (such as trademark, design, symbol, etc.) of the other Party.
CHALLENGE PRIZE VALUE
Each of the winners of the Challenge, as determined by the Awards Jury in their sole discretion (the “Winner(s)”) will receive an investment as a prize (the “Prize”) as described below:
- Early Entry Winners’ Prize: All Participants with complete, eligible Entries submitted by the published Early Entry deadline will automatically be considered for an Early Entry Prize and will receive Ashoka’s feedback before the end of the published General Entry deadline on how to improve their application. Up to ten (10) Applicants from this group will be selected by the Awards Jury to receive up to $15,000 each as an Early Entry Prize. The Awards Jury may at its sole discretion prioritize applications focused on bringing structural changes to select metropolitan areas.
- Challenge Winner Prize: Up to ten (10) Participants selected as Challenge Winners may be selected by the Awards Jury to receive up to $100,000 each as a Challenge Winner Prize. The Awards Jury may at its sole discretion prioritize applications focused on bringing structural changes to select metropolitan areas. The Awards Jury may at its sole discretion allocate a specific number of Challenge Winner Prizes to be designated for market-based solutions or policy-based solutions.
The value of the Early Entry Winners’ Prizes and the Challenge Winner Prizes will depend on its various merits and needs and will be determined at the sole discretion of the Awards Jury. The disbursement of the Prizes may be subject to a due diligence process conducted by Ashoka.
The receipt of the Prizes may be subject to various federal, state, and/or local taxes, depending on the receiving organization’s tax status. It is each Winner’s responsibility to comply with all applicable laws, including tax laws. In this respect, the Prizes are granted as gross amount, and any applicable tax will be due and payable by the Winner, except if the applicable law explicitly provides for the liability of the donor. The Prize will be awarded in US Dollars. All costs associated with currency exchange are the sole responsibility of the Winner.
CHALLENGE AWARD USE
The Winner(s) agree(s) upon receipt of the Prize to use the funds exclusively to support the furtherance of the winning Entry and the purpose of the initiative as outlined in the Entry only. The Winner(s) agree(s) to use the funds to act in good faith in advancing racial equity.
Following the awarding of the Prizes, Ashoka reserves the right to review documentation of the disbursements of the money paid to the winning Entry(ies).
Winners agree to regular and appropriate monitoring and evaluations by Ashoka, as well as to provide progress reports as may be required by Ashoka.
PARTICIPATION
The Applicant must be a legal resident of the United States or Puerto Rico. Entries must be submitted in English and an Applicant is not allowed to submit more than one application.
By submitting an Entry, the Applicant agrees to be bound by these Terms and by the decisions of Ashoka, which are final and binding on all matters pertaining to this Challenge. Prizes are awarded without warranty of any kind from Ashoka or any of their affiliated companies, express or implied, without limitation, except where this would be contrary to federal, state, provincial, or local laws or regulations. Any finalist Applicant who is not available to attend events related to being a finalist or a Winner may, at Ashoka’s sole discretion, be disqualified, and alternative Applicant(s) may be invited from the semifinalist or finalist groups.
To the extent permitted by law, Applicants agree to hold Ashoka, its subsidiaries, agents, directors, officers, employees, representatives and assigns harmless from any injury or damage caused or claimed to be caused by participation in the Challenge and/or use or acceptance of any Prize awarded, except to the extent that any death or personal injury is caused by the negligence of Ashoka. Ashoka is not responsible for any typographical or other error in the printing of the offer, in the administration of the Challenge or in the announcement of the Challenge. An Applicant may be prohibited from participating in this Challenge if, in Ashoka’s sole discretion, it reasonably believes that the Applicant has attempted to undermine the legitimate operation of this Challenge by cheating, deception, or other unfair practices or annoys, abuses, threatens or harasses any other Applicants, Ashoka, or associated agents or parties.
To the maximum extent permitted by law, each Applicant indemnifies and agrees to hold harmless Ashoka, its subsidiaries, agents, affiliates, agents, directors, officers, employees, representatives and assigns, at all times, from and against any liability, actions, claims, demands, losses, damages, costs and expenses for or in respect of which Ashoka will or may become liable by reason of or related to any act, default or omission by the Applicant and/or a breach of any warranty set forth herein.
To the maximum extent permitted by law, each Applicant indemnifies and agrees to hold Ashoka, its subsidiaries, agents, directors, officers, employees, representatives and assigns harmless at all times from and against any liability, actions, claims, demands, losses, damages, costs and expenses for or in respect of which Ashoka will or may become liable by reason of or related or incidental to any act, default or omission by an Applicant under these Challenge Terms and Rules including without limitation resulting from or in relation to any breach, non-observance, act or omission whether negligent or otherwise, pursuant to these official rules by an Applicant.
COMMUNICATION RIGHTS
These Terms grant Ashoka the right to share your Entry information (including without limitation your name, likeness, and the name and details of your project) that was submitted for public view with journalists, via social media, on third party websites, or in third party publications. Ashoka may use, reproduce, distribute, transcribe, translate, promote, broadcast, exhibit, publicly display material you have provided or made available for public use in your Entry.
JURISDICTION
These Terms are subject to change; any change will be published on https://challenge.economicarchitectureproject.org/challenge-terms/. The Terms and administration of the Challenge will be governed by the laws of the United States of America and the relevant court of Virginia shall have jurisdiction.
NO RECOURSE TO JUDICIAL OR OTHER PROCEDURES: To the extent permitted by law, the rights to litigate, to seek injunctive relief or to make any other recourse to judicial or any other procedure in regard to the judgment of the Judges Panel for the Challenge are hereby excluded, and any Applicant expressly waives any and all such rights.
